Service: Refers to the digital marketing and web services provided by the Company.
You: The individual or legal entity accessing the Service.
4. Restrictions
You agree not to:
Modify, reverse engineer, or commercially exploit the platform or service.
Remove any copyright, trademark, or proprietary notices belonging to the Company.
5. Payment, Returns, and Refund Policy
Because our services are labor-intensive and customized, we adhere to the following:
Web Design: Initial deposits are non-refundable. If a project is canceled mid-way, a pro-rated fee for work completed will be retained. Once a site is "Live," no refunds are issued.
Marketing Retainers: SEO and Social Media monthly fees are non-refundable. Cancellation requires 30 days' written notice.
Third-Party Costs: Any "Ad Spend" paid to platforms like Google or Meta is non-refundable by the Company.
Client Inactivity: Projects stalled for more than 30 days due to client non-communication may be terminated without a refund.
6. Intellectual Property
All content, features, and functionality (text, images, code) are the exclusive property of TURNER AURA MODE COLLECTIVE LLC. Any suggestions or feedback provided by you become the property of the Company without compensation.
7. Limitation of Liability
To the maximum extent permitted by applicable law, TURNER AURA MODE COLLECTIVE LLC shall not be liable for any indirect, incidental, or consequential damages (including loss of profits or data). Our total liability shall not exceed the actual amount paid by you for the specific service in question.
8. Disclaimer: "As Is" and "As Available"
Our services are provided without warranties of any kind, whether express or implied. We do not guarantee specific search engine rankings, lead counts, or sales figures, as these are subject to third-party algorithm changes (Google/Meta).
9. Governing Law & Dispute Resolution
This Agreement is governed by the laws of the State of Missouri, United States, without regard to its conflict of law provisions.
Arbitration: Any dispute arising out of this Agreement shall be settled by binding arbitration in Kansas City, Missouri, in accordance with the rules of the American Arbitration Association (AAA).
Court Proceedings: If arbitration is not applicable, you consent to the exclusive jurisdiction of the state and federal courts located in Clay County, Missouri.
10. Privacy & Data Protection
We value your privacy. While we operate under U.S. law, we strive to maintain high standards of data protection. Please refer to our Privacy Policy for details on how we handle Personal Data and our use of Cookies.
11. Amendments
We reserve the right to modify these terms at any time. For material changes, we will provide at least 30 days' notice via our website or email before new terms take effect.
